I know the reasons he's probably in are:
-Evil Cole has completely different powers. ...Right?
and
-The player could choose one or the other, so including only one excludes the other group of players.
But it still seems kind of dumb!
It's worth noting that Cole's bio on the website specifically mentions that he's a selfless hero on the path of good.
I guess that does set the stage for Evil Cole doesn't it
Considering the other Supers there's pretty much no chance it is not going to be horribly imbalanced.
Some of them are completely unavoidable kills on all other players, and others require aiming but are tuned so that you can kill one person multiple times with it.
They are balanced even worse than Smash Orbs...

But remember, using a super is the only way to score a kill. The point of attacking at all is to charge your meter.
In other words, using a level 3 is the equivalent of killing your opponent at least three times over! If you can do that, then quite frankly, you deserve those unavoidable kills.
You can't somehow evade the knock-out when your health reaches zero in a regular fighting game, can you?
Plus, if some level 3s are unavoidable kills, but others require aim but have the potential to score more kills, then that's balance!
You can't really approach this game with the same viewpoint you'd use for regular fighting games, or even Smash Bros, since the core element is a bit different from the norm.
The difference here is that it is not a measure of your personal skill.
You are not being rewarded for playing well and scoring a kill on someone, you are potentially being punished for someone else playing badly and thus allowing a third party to get a completely unavoidable kill on you, sometimes more than one.
This is just not what I can consider good game design.
Now, that right there is a legitimate concern, but I'm not worried about it.
BECAUSE:
-For the unavoidable kill, you'd have to beat up on the bad player until your meter goes from zero to three. That'd take a while! During this time, other players have ample opportunity to respond.
-It takes a certain degree of skill to recognize the opportunity to beat up on bad players, and then to seize the opportunity. Not much, but there is some!
-If you notice that a good player is beating up a bad player, you can respond! You've got time.
You could try beating up the bad player first, for example. Or better yet, hit the good player! If he's beating up on someone, he won't be able to counter you as effectively.
-This is a non-issue in 1v1 anyway.
It's not as simple as bad players dooming the whole group. Plus, there are a host of other factors that could influence this dynamic, like whether it takes more time to go from 2 to 3 than it does from 1 to 2, for example.
It could be an issue sometimes, but it's not luck-of-the-draw, and it's definitely not unavoidable!
In many ways, this game is shaping up to be much, much more skill-oriented than Smash Bros.

Yeah, have I ever mentioned that I hate video game culture almost entirely? Bayonetta, I guess, was aiming for some kind of parody angle, but I think it missed the mark if it was. Lollipop Chainsaw... I don't even see the parody angle in. Now, it's very likely that I'm just a dumb fuck and completely missing something.
